§1 Preliminary provisions

  1. Our Press Shop, available at. www.naszatlocznia.pl, is run by Gospodarstwo Sadownicze Zbigniew Pietrzycki, based in 05-660 Warka, Konary 92. The business activity is registered in the Central Register and Information on Business Activity (CEIDG), maintained by the minister responsible for economy, NIP 797-127-18-11 , REGON 672798121.
  2. These Regulations are addressed to Customers and set out the rules and procedures for concluding a Remote Agreement with the Customer through the Online Store.
  3. Condition setting up an Account and/or Placing an Order in the Online Store is acceptance of the provisions of the Terms and Conditions.
  4. All rights to the content made available by the Seller within the framework of the Online Store, in particular, copyrights to images, the name of the Online Store, trademarks and graphic elements included therein, software and database rights, are subject to legal protection and belong to the Seller. It is forbidden to copy or otherwise use any elements of the Online Store without the consent of the Seller.

§2 Definitions

  1. Customer - a natural person, legal entity or organizational unit, concluding a contract with the Seller through the Online Store and accepting the Regulations.
  2. Entrepreneur on the rights of a Consumer - a Customer who is a natural person concluding a Sales Contract directly related to his/her business activity, when the content of the Sales Contract shows that it does not have a professional character for this Entrepreneur, resulting in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.
  3. Seller - a natural person conducting business activity under the name of Gospodarstwo Sadownicze Zbigniew Pietrzycki, registered in the Central Register of Business Activity and Information kept by the minister responsible for economy, NIP 797-127-18-11, REGON 672798121.
  4. Online store - Internet service, available at www.naszatlocznia.pl, through which the Customer can place Orders, as well as use other Electronic Services.
  5. Contract - a contract concluded with the Customer through the Online Store in the understanding of the provisions of the Civil Code Act, within an organized system of contract conclusion at a distance.
  6. Regulations - these Regulations of the Nasza Tłocznia online store.
  7. Order - a declaration of will of the Customer aiming directly at concluding a Contract of Sale of Products at a distance, submitted via the Online Store, specifying the type and number of ordered Products.
  8. Product - a movable thing presented in the Online Store by the Seller, which can be the subject of a Contract concluded with the Customer.
  9. Shopping Cart - an element of the Online Store's software, where the Products selected by the Customer for purchase are visible, and it is possible to determine and modify the Order data, in particular the quantity of products.
  10. Account - Customer's account in the Online Store, where the data provided by the Customer and information about the Orders placed by the Customer are collected.
  11. Registration form - a form available on the Online Store that allows you to create an Account.
  12. Order Form - an interactive form available on the Online Store that allows you to place an Order, in particular by adding Products to the Cart and specifying the terms of the Agreement, including the method of delivery and payment.
  13. Electronic services - services provided electronically by the Seller to Customers, under the terms of the Regulations, through the Online Store.

§4 General information

  1. To the fullest extent permitted by law, the Seller shall not be liable for any disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized actions of third parties or incompatibility of the Online Store with the technical infrastructure of the Customer.
  2. Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible either after setting up an Account or by providing the necessary personal and address data to allow the Order to be processed without setting up an Account.

§5 Customer's rights and obligations

  1. The Customer is the only person authorized to perform operations on his Account. The Customer is obliged to secure access to the Account, in particular not to transfer access data to the Account, including the password, to third parties.
  2. The Account contains information provided by the Customer during registration. The Customer, after logging into the Account, can view his/her data and modify it.
  3. The customer is obliged to comply with the provisions of the Terms and Conditions and use the Online Store in a manner consistent with the provisions of applicable law and not to interfere with its operation or hinder the use of other customers.
  4. It is forbidden for the Customer to place content of an unlawful nature in the Online Store, in particular content: violating the law, unsuitable for persons under 18 years of age, containing threats, inciting aggression, misleading, containing vulgarisms and phrases that may violate the dignity of third parties, promoting any websites, products, goods or services of third parties.
  5. During registration, the customer is required to provide true data.
  6. The Customer has the right to file a complaint related to the provision of electronic Services by the Seller, which is specifically defined in paragraph 11 of these Regulations.

§6 Seller's rights and obligations

  1. As part of the provision of Electronic Services, the Seller ensures the technical efficiency and correctness of the operation of the Online Store, in particular - allows Customers to place Orders.
  2. The vendor shall ensure the protection of electronic transmission through the use of technical and organizational measures to protect the data from being obtained by unauthorized persons.
  3. If the Customer: provided false data, committed a violation of the personal rights of third parties, in particular the personal rights of other Customers, committed behavior that is inconsistent with the Regulations or applicable laws, the Seller may:
    1. call on the Client to desist from violations and remove their consequences,
    2. refuse to accept the Order or permanently delete the Account or temporarily block the Customer's access to the Account - after an ineffective request to cease violations or remove the effects of the violations made,
    3. in the event of posting content that violates the law, the provisions of the Rules or good morals - withhold publication of such content on the Online Store website, remove such content or block access to it.
    4. The Seller undertakes to properly process Orders placed by Customers and to exercise all due diligence in providing information.

§7 Rules for placing an Order

  1. Information about the Products given in the Online Store, in particular their descriptions, parameters and prices, do not constitute an offer within the meaning of the Civil Code, and are only an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  2. Before placing an Order, the Customer should read the description of the Product, available on the Online Store.
  3. The Customer may place Orders for Products on the Online Store 24 hours a day, 7 days a week.
  4. Placing an Order does not require registration or creating an Account.
  5. In order to place an Order, you must:
    1. come to www.naszatlocznia.pl,
    2. make a product selection,
    3. place an Order by taking subsequent technical actions based on the messages or information displayed to the Customer.
  6. After placing an order, the customer will receive an e-mail confirming the receipt of the order by the Seller.
  7. An employee of the Online Store may contact the Customer to confirm the contents of the Order by telephone. As soon as the Customer receives the e-mail message referred to in the above paragraph, the Contract of Sale between the Customer and the Seller is concluded.
  8. If you find any inaccuracies in the contents of the message about the receipt of the Order, you should contact the Seller by phone or by e-mail, sending a message to the address: biuro@naszatlocznia.pl.
  9. The Seller attaches a receipt or a VAT invoice to each Order, depending on the Customer's preference.

§8 Payments

  1. Prices of Goods located in the Online Store, are given in Polish currency and are gross prices (i.e. they include VAT).
  2. The prices of the Goods do not include delivery costs (if applicable), which are indicated each time in the process of placing an Order. The total value of the Order includes the price of the ordered Products and delivery costs.
  3. The customer can choose one of the available forms of payment: bank transfer, mobile payments through a service that mediates payments and indicated on the pages of the Online Store (imoje payments, operated by ING Bank Śląski S.A. based in Katowice, Przelewy24 payments operated by PayPro SA), cash on delivery or payment by cash/card in case of personal collection.
  4. In the case of payment by bank transfer, the Order number must be indicated in the title.
  5. In the case of payment by bank transfer or mobile payment, the Customer is required to make payment within 48 hours of placing the Order, otherwise the Order may be canceled, of which the Customer will be immediately informed by the Online Store staff.
  6. In the case of cash on delivery payment, the Customer is obliged to collect the shipment and pay the entire amount of the Order during delivery. Otherwise, the Seller may charge the Customer for shipping and return of the unclaimed Order.

§9 Delivery

  1. Delivery of the placed Order to the Customer shall be subject to payment in accordance with the delivery terms offered by the Seller, which shall be announced during the placement of the Order.
  2. The Seller provides information about the cost of delivery when placing an Order, at the time of selecting the method of delivery.
  3. Delivery of a placed Order is possible only through entities cooperating with the Seller.
  4. In the case of delivery of an Order outside the territory of the Republic of Poland, delivery costs may differ from those specified. If you wish to place an Order with delivery Outside the Republic of Poland, please send your request by e-mail to biuro@naszatlocznia.pl.
  5. Delivery time depends on the date of placing the Order. Products are shipped to the Customer immediately upon receipt of payment or, in the case of cash on delivery, immediately after the Order is placed, taking into account weekends and holidays.
  6. In case of ordering Products with different readiness dates, the readiness date shall be the longest date given.
  7. The seller should execute the Sales Contract no later than thirty days after its conclusion.
  8. When receiving the shipment, the customer should carefully inspect it to determine that the shipment does not have any damage caused during transportation and that its contents are in accordance with the Order.
  9. In case of irregularities, the carrier should be requested to draw up a damage report, and the incident should be immediately reported to the Seller.

§10 Right of withdrawal

  1. The Customer (Consumer and Entrepreneur on the rights of the Consumer) may withdraw from the Agreement within 14 days without giving any reason.
  2. The running of the period specified in item 1 begins from the date of delivery of the Product to the Customer.
  3. In the case of a Contract that includes multiple Products that are delivered separately, in batches or in parts, the term indicated in Section 1 shall run from the delivery of the last item, batch or part.
  4. The Consumer may withdraw from the Contract by submitting to the Seller a completed and signed statement of withdrawal from the Contract (Return of Goods Form downloadable below). To meet the deadline for withdrawal from the Contract, it is sufficient for the Consumer to send the statement before the deadline.
  5. The statement may be sent via snail mail or e-mail. It should contain the Customer's data, order number, sales document number, indication of the returned Product and optionally the reason for return.
  6. The returned product must reach the Seller intact, bearing no signs of use along with confirmation of purchase - receipt or VAT invoice and a completed and signed return form. Returns that do not contain a sales document or return form will not be processed.
  7. The cost of delivering the returned Product to the Seller shall be borne by the Customer.
  8. Shipments sent COD will not be received.
  9. The Seller will return the payment using the same methods of payment that were used by the Customer in the original transaction, unless the Customer has expressly agreed to another solution that will not incur any costs for him .
  10. The Seller will refund the payment within 14 days from the moment of determining the reasonableness of the return, i.e. determining that the product bears no traces of use and the return contains all the required documents listed in Section 6 of this paragraph.

§11 Complaint

  1. The Seller is responsible for the proper quality of the Products sold.
  2. All complaints may be submitted within a maximum of 14 days after the Customer notices irregularities related to the Order or the Product.
  3. The Customer (Consumer and Entrepreneur on the rights of the Consumer) can make a complaint by submitting a complaint statement (Goods Complaint Form to download below).
  4. The complaint statement may be submitted by snail mail or e-mail.
  5. The product under complaint should be delivered together with the proof of purchase and a completed and signed claim form.
  6. The cost of sending back the claimed Product shall be borne by the Seller by providing the Customer with a shipping label.
  7. Shipments sent COD will not be received.
  8. Complaints will be processed by the Seller within 14 days of receipt of the product.

§12 Data protection

  1. The administrator of Customers' personal data collected through the Online Store is the Seller.
  2. Customers' personal data collected by the administrator through the Online Store are collected for the purpose of executing the Agreement, and if the Customer agrees - also for marketing purposes.
  3. Recipients of personal data of Customers of the Online Store may be:
    1. In the case of a Customer who uses the method of delivery by mail or courier in the Online Store, the Seller shall make the collected personal data of the Customer available to the selected carrier or intermediary performing the shipments.
    2. In the case of a Customer who uses the electronic payment method in the Online Store, the Seller shall make available the collected personal data of the Customer, to the selected entity handling the above payments in the Online Store.
  4. The customer has the right to access and correct the content of his data.
  5. Provision of personal data is voluntary, but failure to provide the personal data indicated in the Regulations necessary to conclude the Agreement results in the inability to conclude the Agreement.

§13 Final provisions

  1. Contracts concluded through the Online Store are concluded in the Polish language.
  2. The Seller reserves the right to make changes to the Terms and Conditions for important reasons, i.e.: changes in legislation, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Customer will be informed of each change by the Seller.
  3. In matters not covered by these Regulations, the generally applicable provisions of Polish law shall apply, in particular: Civil Code; Law on Providing Electronic Services; Law on Consumer Rights, Law on Personal Data Protection.
  4. The customer has the right to use out-of-court means of handling complaints and claims.
  5. The regulations come into force on 05/07/2018.
